DMCA policy
NANO IPTV respects intellectual property rights. Here is how to submit a takedown notice.
Our position
NANO IPTV does not host, store, or transmit any copyrighted material. The service is a routing layer over public broadcasts and properly licensed providers. We respect intellectual property rights and respond promptly to all valid DMCA takedown notices.
We have implemented a repeat-infringer policy and maintain a designated DMCA agent registered with the U.S. Copyright Office to handle all notices under 17 U.S.C. §512.
Safe harbour designation
NANO IPTVoperates in good faith under the safe harbour provisions of the Digital Millennium Copyright Act (17 U.S.C. §512). As a service provider, we qualify for protection under §512(a), (b), (c), and (d) where applicable, provided that:
- We do not have actual knowledge of infringing activity on the service.
- We do not receive a financial benefit directly attributable to infringing activity that we have the right and ability to control.
- We expeditiously remove or disable access to material that is claimed to be infringing upon receipt of a valid notice.
How to submit a notice
Under 17 U.S.C. §512(c), a valid takedown notice must include all of the following six elements. Incomplete notices may delay processing:
- Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, provide a representative list.
- Identification of the infringing material with enough detail for us to locate it, including the specific URL or stream identifier.
- Your contact information— full legal name, postal address, telephone number, and email address.
- Good-faith statement— a statement that you have a good-faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement under penalty of perjury— a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.
- Signature— your physical or electronic signature.
Where to send it
Send your notice to: legal@nanoiptv.com
We aim to acknowledge all valid notices within 24 hours and act on them (removal or disabling of access) within 5 business days. If the notice requires further investigation, we will notify you of any delay.
You may also use the form below this document to submit a notice electronically. All submissions are forwarded directly to our legal team.
Counter-notice
If you believe content was removed in error or that you have the right to use the material, you may submit a counter-notice. A valid counter-notice must include the same six elements listed above, plus:
- Consent to jurisdiction— a statement consenting to the jurisdiction of the federal court in the district where you are located (or, if outside the United States, the judicial district in which NANO IPTV may be found).
- Acceptance of service— a statement that you will accept service of process from the person who filed the original takedown notice or their agent.
Upon receiving a valid counter-notice, we will forward it to the original claimant. If the claimant does not file a court action within 10–14 business days, we may restore the removed content at our discretion.
Material misrepresentation
Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake or misidentification, may be liable for damages. This includes damages suffered by the account holder, NANO IPTV, and any ISP or hosting provider involved.
We take false claims seriously. Submitting a fraudulent DMCA notice may result in the suspension of your ability to submit future notices and may be reported to the appropriate authorities.
Repeat infringers
In accordance with the DMCA and our internal policies, we will terminate the accounts of users who are the subject of repeated valid takedown notices. We maintain a record of all notices received and the actions taken in response.
We reserve the right to terminate accounts at our discretion upon the first valid notice if the nature or scale of the infringement warrants it.
